Rule 30
Proceedings in relation to cases filed by or on behalf of the Government of Nepal
(1) Before submitting a complaint, counter-answer, written defense or appeal in a case filed by the Government of Nepal or to be filed on behalf of the Government of Nepal, the relevant departmental head or head of office shall take necessary legal advice from the relevant government lawyer before submitting such complaint. The counter-answer, written counter-argument, appeal and documents and evidence related to the case should be collected and submitted to the relevant court or agency in case it is to be submitted by oneself, and if it is to be submitted by the public prosecutor, it should be sent to the relevant public prosecutor. In this way, the petition, counter-answer, written response or appeal received from the public prosecutor should be submitted by the public prosecutor to the relevant court or agency.
(2) For defense in the case under sub-rule (1), the concerned agency shall send to the concerned public prosecutor's office.
(3) When sending in writing to defend according to sub-rule (2), the related missile documents must also be sent in a correct manner. If the case is affected due to the failure of the relevant officer or officials to send the necessary documents, the relevant public prosecutor should inform the head of the department.
